Terms of Use
This is an informative translation. In case of discrepancy, the Spanish version shall prevail.
1. Definitions
For the purposes of this document:
- Eventgoing or the Platform: the web application accessible at eventgoing.com and its subdomains, which provides technological infrastructure for the creation, management and distribution of events and invitations.
- Owner: the natural or legal person responsible for the Platform, identified in the Legal Notice.
- User: any person who accesses the Platform, with or without a registered account.
- Organizer: the User who creates an account and uses the Platform to create and manage events.
- Attendee: the person who receives an invitation to an event and may respond to it. Attendees do not need an account on the Platform.
- Event: any occurrence created by an Organizer through the Platform.
- RSVP: confirmation or decline of attendance at an Event by an Attendee.
- Content: any information, text, image, link or other material that a User publishes or enters on the Platform.
2. Purpose of the service
The Platform provides technological tools that allow Organizers to create events, manage guest lists, receive attendance confirmations and share invitations through URL.
The Platform is currently in early access. Certain features, plans and availability conditions may change before general release.
The Platform does not organize events. The Platform does not represent Organizers. The Platform does not act as a contractual intermediary between Organizers and Attendees. The relationship between the Organizer and its Attendees is independent from and outside the Platform.
3. Acceptance
Use of the Platform implies full acceptance of these Terms of Use. If you do not agree with any of them, do not use the Platform.
Registering an account requires express acceptance of these Terms.
4. Registration and accounts
4.1. Requirements
To create an account, you must be at least 16 years old and provide a name, a valid email address and a password.
Accounts are strictly personal. Each account corresponds to one natural person and one unique email address. Sharing accounts or creating accounts with false identities is not permitted.
4.2. Business use
Companies or organizations may use the Platform through a natural person who will be responsible for the account and for compliance with these Terms.
4.3. Account security
The Organizer is solely responsible for maintaining the confidentiality of its access credentials and for any activity carried out through its account.
5. Permitted use
The User undertakes to use the Platform in accordance with applicable law, these Terms and public order.
It is prohibited to:
- Use the Platform for unlawful purposes or purposes contrary to these Terms.
- Publish content that infringes third-party rights, including intellectual property rights, honor, privacy or image rights.
- Publish discriminatory, defamatory, violent, pornographic content or content that incites hatred.
- Use the Platform to send unsolicited commercial communications (spam).
- Attempt to access third-party accounts or internal Platform systems without authorization.
- Perform actions that may overload, damage or disable Platform infrastructure.
- Automate access to the Platform through bots, scrapers or other unauthorized means.
6. Organizer responsibilities
The Organizer is solely responsible for:
- The accuracy and legality of the Content it publishes, including text, images and links.
- Managing the relationship with its Attendees.
- Compliance with regulations applicable to its event, including licenses, permits, local regulations and tax obligations.
- Obtaining any required consent to include Attendee data on the Platform.
- The legality of any charge, transaction or agreement entered into with Attendees or other third parties.
7. Paid events
Organizers may create free or paid events. The Platform does not process payments of any kind. If an Organizer charges for attendance at an event, the economic relationship exists exclusively between the Organizer and the Attendee, without any intervention or liability of the Platform.
8. Attendees
Attendees access the Platform through invitations shared by Organizers. To respond to an invitation, the Attendee provides name, email address and attendance response (RSVP).
Attendees do not need to create an account on the Platform.
The processing of Attendee data is detailed in the Privacy Policy.
9. Content
9.1. Ownership
The Organizer retains ownership of all Content it publishes on the Platform.
9.2. License of use
By publishing Content on the Platform, the Organizer grants the Owner a non-exclusive, royalty-free and limited license to store, process and display such Content solely for the purpose of providing the service. This license ends when the Content is removed from the Platform.
9.3. Third-party content
The Platform does not pre-review Content published by Organizers. The Owner is not responsible for User-generated Content.
10. Intellectual property
The Platform, its code, design, brand, logos and other elements that make it up are owned by the Owner or its licensors. Reproduction, distribution or transformation of these elements is prohibited without express authorization.
11. Moderation and suspension
The Owner reserves the right to:
- Remove Content.
- Suspend or cancel User accounts.
- Archive Content.
These actions may be taken when necessary for legal, technical or security reasons, or for breach of these Terms, without prior notice and without creating any right to compensation.
12. Limitation of liability
The Platform is provided "as is" and "as available".
The Owner shall not be liable for:
- The organization, cancellation or execution of events created by Organizers.
- Personal injury or material damage arising from events.
- Conflicts between Users, or between Organizers and Attendees.
- Contractual, legal or tax breaches by Organizers.
- Payments, charges or economic transactions between third parties.
- Data loss due to causes not attributable to the Owner.
- The conduct of other Users inside or outside the Platform.
In no event shall the Owner's total liability to a User exceed the amount that such User has paid to the Owner during the twelve months prior to the event giving rise to the claim. If the User has made no payment, maximum liability shall be zero.
13. Service availability
The Owner does not guarantee continuous or uninterrupted availability of the Platform. The service may be interrupted due to maintenance, updates, technical failures or other causes.
The Owner does not offer service level agreements (SLAs), guaranteed response times or compensation for interruptions.
The Owner may modify, suspend or discontinue the Platform, in whole or in part, at any time and without prior notice.
14. Support
The Platform does not offer guaranteed technical support. A contact email address may be available, but there is no obligation to respond and no committed response timeframe.
15. Data protection
The processing of personal data is governed by the Privacy Policy, available on the Platform. The Privacy Policy forms an integral part of these Terms.
16. Account deletion
The Organizer may request account deletion from its account area, choosing between:
- Immediate deletion: the cancellation process starts with immediate effect on access and subscription.
- Deletion at end of period: the account is marked for deletion on the end date of the applicable billing or trial period.
Where deletion is scheduled at the end of period, the Organizer may cancel it from its account area before the effective date.
After account deletion:
- The Organizer's personal data and associated Content will be deleted.
- Activity logs may be retained for up to 30 days for security and legal compliance reasons.
- Attendee data linked to Organizer events will be deleted as set out in the Privacy Policy.
Technical execution of deletion may involve automatic deletion or anonymization processes to preserve system integrity and comply with legal obligations.
17. Modifications
The Owner may modify these Terms at any time. Modifications will be published on the Platform and will become effective upon publication.
Continued use of the Platform after publication of modifications constitutes acceptance of the new Terms. If the User does not agree with the modifications, it must stop using the Platform and, where applicable, request account deletion.
In case of substantial modifications, the Owner will make reasonable efforts to notify registered Users via the email associated with their account.
18. Partial invalidity
If any clause of these Terms is declared null or unenforceable, the remaining clauses shall remain valid and effective.
19. Applicable law and jurisdiction
These Terms are governed by Spanish law.
Any dispute arising from interpretation or application of these Terms shall be submitted to the courts of Barcelona, unless mandatory consumer protection regulations provide otherwise.
